Matter of state government employees acting as commission in cases of rape of minors in the state

It is imperative that the accused caught in cases of rape of minors in the state be closely and thoroughly investigated and that such accused do not get the benefit of the law during court proceedings. In order to complete the judicial proceedings against the accused caught in such crimes within the time limit (6 months) and convict the convicts, the matter of keeping Sarkari Saheed as Punch Saheed in such cases was under consideration of the Government, Rao said.  

It is hereby resolved to seek the assistance / operation of a Government servant as a Punch subject to the following conditions during the proceedings;  Cards and Manners: 1, 2, All employees from government offices of all cities / districts of Gujarat can be taken as Punch for cases of rape of minors.  In such cases, when the employee acts as a Government Punch, his / her work shall be deemed sufficient and he / she shall not be compelled to file leave report.  

When the help of the Punch is sought by the Police Department for cases of rape of minors, the heads of the Survey Department / Office under their jurisdiction. The employee will have to be allotted a fixed amount for the operation as a Punch.  If there is any mistake in this matter, it will be treated as serious. In case of rape of minors, no employee / officer of the police department will have to be selected as the Punch.  The government employee who is selected as the Punch should be neutral in all circumstances.

They have to be careful not to come under the influence of anyone or under the pressure of the police.  In such cases, class-3 government employees will have to be selected as commission.  Among the Class-II employees, the employees working on contract basis with fixed salary cannot be kept as Punch. 

At the time of selection of tribunals, only government employees, especially senior clerks or higher level employees / officers, should be included in the tribunals so that their face-to-face statements in judicial proceedings in such important cases can get proper and accurate result.  

In order to have a neutral commission, it is necessary to make a proposal to take witnesses of the commission not only from the district headquarters but also from the place where the taluka is headquartered and / or there is a rural / urban area with a population of more than 15 thousand. 

All the departments of the Secretariat are hereby informed to ensure that necessary instructions are given to the heads of all the departments under the Survey Department for the smooth implementation of the above procedures and instructions.  This resolution is on the file of the same number of this department.  Issued as per the approval received from the note dated 12/11/2020 and Government's dated 19/11/2020.
